This Privacy Notice for Nexlo ("we," "us," or "our"), a Delaware C Corporation, describes how and why we might collect, store, and use your information when you use our Services. This policy includes specific terms related to SMS messaging to comply with carrier requirements.

This policy applies to:

  • • Our business customers ("Clients") who use our AI operations assistant platform.
  • • The customers of our Clients ("End-Users") who interact with our automated service via SMS.

1. INFORMATION WE COLLECT

Information from Our Clients

We collect personal information that our Clients voluntarily provide to us when they register for an account or contact us. This may include:

  • • Names and email addresses
  • • Passwords
  • • Billing information

Information We Process for Our Clients (from End-Users)

As part of our Service, we collect information from End-Users on behalf of our Clients. For the purposes of data privacy laws like GDPR, our Client is the Data Controller and Nexlo is the Data Processor. The information we collect includes:

  • • The End-User's phone number.
  • • The explicit answers an End-User provides during the automated SMS conversation.

2. HOW WE USE YOUR INFORMATION

We use Client information to:

  • • Create and manage Client accounts.
  • • Provide, operate, and improve our Services.
  • • Communicate with our Clients, including for support and billing.
  • • Maintain the security of our Services.

We use End-User information for the sole purpose of providing the Services to our Client. We process this data as directed by the Client on whose behalf it was collected.

3. SMS MESSAGING POLICY

This section outlines our policies specifically related to SMS communications.

Collection and Use of Phone Numbers

We collect End-User phone numbers only when voluntarily provided during an interaction with our Services on behalf of a Client (e.g., by texting a Client's number). By providing your phone number, you opt-in and consent to receive SMS messages from our automated service.

Your phone number is used to facilitate the automated conversation to collect structured information as requested by our Client. Standard SMS messaging charges from your carrier may apply.

Sharing of Phone Numbers

We will only share your phone number with our third-party SMS provider to enable the delivery of messages. This sharing is subject to the provider's privacy policy. We will not sell or transfer your phone number to any other party for marketing or other purposes.

Opting Out of SMS Messages

If at any time you wish to stop receiving SMS messages from our service, you can opt-out by texting STOP in reply to any message. Upon receiving your opt-out request, we will cease sending you messages.

4. HOW WE SHARE YOUR INFORMATION

We do not sell, rent, or share personal information with any third parties for their own commercial purposes.

Data collected from an End-User is stored securely in a private database and is only made available to the specific Client who initiated the interaction.

5. DATA RETENTION

We keep your information only for as long as necessary to fulfill the purposes outlined in this notice or as required by law.

  • • We keep Client account data for as long as the account is active.
  • • We keep End-User data for the period of time determined by our Client.

When we no longer have a business need to process your information, we will delete or anonymize it.

6. DATA SECURITY

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, no electronic transmission or storage technology is 100% secure, and we cannot guarantee absolute security.

7. INFORMATION FROM MINORS

We do not knowingly collect data from or market to children under 18 years of age. If you become aware of any data we may have collected from children under 18, please contact us at support@nexlo.com.

8. YOUR PRIVACY RIGHTS

  • For Clients: You may review, change, or terminate your account at any time by logging into your account settings or contacting us.
  • For End-Users: Because we process your data on behalf of our Client, you should direct any requests to exercise your data protection rights (such as access or deletion) to the business you interacted with. We will assist our Clients in responding to these requests.

9. SPECIFIC RIGHTS FOR UNITED STATES RESIDENTS

If you are a resident of California or another state with applicable privacy laws (e.g., CCPA), you have specific rights regarding your personal information, including the right to request access to or deletion of your data.

Nexlo does not "sell" personal information as defined by the CCPA.

To exercise your rights, please see Section 8. End-Users should contact the business they interacted with (our Client).

10. UPDATES TO THIS NOTICE

We may update this notice as necessary to stay compliant with relevant laws. The updated version will be indicated by the "Last updated" date at the top of this page. We will notify you about significant changes by placing a prominent notice on our site or by other means.
